Heartshop Gift Card Terms of Use

These Gift Card Terms of Use (“Gift Card Terms”) govern your purchase, use, and redemption of Gift Cards from the Heart Foundation's Heartshop. They include our Privacy Policy and other documents referred to within these Terms, and form a legally binding agreement between you, the user, and the issuer of the Gift Cards, the National Heart Foundation of Australia ABN 98 008 419 761 (“Heart Foundation”)

These Gift Card Terms are important and you should read them fully. Please note that we may update these Gift Card Terms from time to time without providing individual notice. We encourage you to review this page periodically to stay informed of any changes.

By purchasing, redeeming or using a Heartshop Gift Card, you confirm that you have read, understood, and accepted these Gift Card Terms. 

  1. Gift Cards
    1.1.    Gift Cards can be purchased online through the Heartshop website.
    1.2.    Gift Cards are available in various denominations, as displayed on the Heartshop website. 
    1.3.    A purchase confirmation and receipt will be provided via email upon completion of the purchase.
    1.4.    Once a Gift Card has been purchased, it may be transferred to any other person. Once redeemed, gift cards cannot be transferred. 
    1.4.1.    For a physical Gift Card, this is done by physically giving it to the other person before it is activated. 
    1.4.2.    For a digital Gift Card, this is done by following the directions on the Heartshop website. 
    1.5.    If you are giving a Gift Card to another person, you should ensure that they are aware of the terms and conditions that apply to the Gift Card and the relevant Expiry Date of the Gift Card.
    1.6.    No fees apply to your use or holding of Gift Cards for:
    1.6.1.    activation fees;
    1.6.2.    account keeping fees; or
    1.6.3.    balance enquiry fees.
    1.7.    Fees may apply in some circumstances and include but are not limited to:
    1.7.1.    overseas transaction fees;
    1.7.2.    booking fees; and
    1.7.3.    payment surcharge fees.
    1.8.    Purchases made using Gift Cards are not refundable, except where required by law, including under the Australian Consumer Law.
    1.9.    In addition to these terms and conditions, Gift Cards may be subject to any other terms and conditions specified on the card.

2.    Validity and Expiry
2.1.    Heartshop Gift Cards are valid for 3 years from the date of purchase.
2.2.    The expiry date is clearly printed on the Gift Card. After the expiry date, any remaining balance will be forfeited, and the Gift Card will no longer be redeemable.

3.    Redemption
3.1.    Gift Cards can be redeemed online at the Heartshop website for merchandise and other eligible items. See our Merchandise Policy for full terms and conditions.
3.2.    To redeem a Gift Card, enter the unique Gift Card code at checkout.
3.3.    If the total purchase amount exceeds the Gift Card's value, the remaining balance must be paid using another accepted payment method.
3.4.    If the total purchase amount is less than the Gift Card's value, the remaining balance will be retained on the Gift Card for future use within the validity period.

4.    Non-Transferable and Non-Refundable
4.1.    Gift Cards are not refundable, returnable, or redeemable for cash except where required by law, whether or not it has been activated. 
4.2.    Gift Cards are non-reloadable, non-transferable (upon redemption, see clause 1.4 above), and must not be resold or exchanged for cash.
4.3.    You may not purchase other Gift Cards with a Gift Card.
4.4.    The Heart Foundation is not responsible for lost, stolen, or damaged Gift Cards. Lost or stolen Gift Cards will not be replaced or refunded.

5.    Balance Enquiry
5.1.    You can check your Gift Card balance by visiting the Heartshop website and entering the Gift Card code in the designated balance enquiry section.
5.2.    Alternatively, you may contact our customer service team for assistance with balance enquiries.

6.    Loss of Gift Card
6.1.    The risk of loss of the Gift Card passes to the Gift Card purchaser at the time of purchase. The Heart Foundation will not be responsible for lost, stolen or destroyed Gift Cards and is not responsible for unauthorised use of the Heart Foundation Gift Card. 
6.2.    To the extent permitted by law, if a Gift Card is non-functional, your sole remedy (and the Heart Foundation’s sole potential liability) will be the replacement of such Gift Card, subject to any additional rights you may have under the Australian Consumer Law.

7.    Fraud 
The Heart Foundation reserves the right to void the Gift Card if it reasonably suspects that the Gift Card was obtained or used fraudulently, unlawfully or otherwise in violation of these Gift Card Terms or our Merchandise Policy.

8.    Assignment and Novation
You agree that the Heart Foundation may novate the issuance of the Gift Card and/or value standing to the credit of the Gift Card, together with all of its other rights and obligations under these Gift Card terms and conditions, to another issuer, without notice to you unless required by law or where such changes (in our reasonable opinion) may have a material detrimental impact to you.

9.    Australian Consumer Law
Without excluding, restricting or modifying the rights and remedies to which you may be entitled under the consumer guarantees provisions of the Australian Consumer Law (and any other non-excludable statutory right), the Heart Foundation’s liability to you in all other cases will be limited to refund or reissue of your Gift Card up to the value of your purchase.

10.    Governing Law
These Gift Card Terms are governed by and must be interpreted in accordance with the laws of Victoria. By accepting these Gift Card Terms, you agree to submit to the exclusive jurisdiction of the courts in Victoria.
